I agree. And the overwhelming opinion of American
courts is that it can be made "substantially" new,
given the information you've presented.
Bryan, as he often does, makes a good point. If
you can find a specific reason why you believe the
boat is unrepairable, and if you can get a surveyor
to agree with you and write a report backing up his
opinion, you have something to talk to a lawyer
about.

From what you've told us, you had a choice between
making two possible claims: an insurance claim with
a deductible, or a warranty claim that probably has
none. It's unclear how you arrived at that decision,
but perhaps it's contributing to the problem.
