    The manufacturer and your insurance carrier have their own
    wishes in this matter. Your wishes and theirs seem to be at
    variance. The law, however, is less concerned with wishes
    than the contractual rights of the parties. Unless your
    warranty gives you the option of demanding a new boat if
    the first one is defective, it's unclear to me what you'd
    base such a claim on.

    But you could waste a lot of time and money pursuing such
    a claim. If you look hard enough, I'm sure you could find
    a lawyer willing to take your money.
