Maybe a page from Common Sense Driving applies here. I think we would all agree that no one is supposed to go through a stop sign. However, I always slow down if I see a car approaching a sign even though I know he is supposed to stop, and the rules and laws say he is supposed to stop. No reason that defensive driving cannot apply to the water as well.... no use being in a collision just because we were right.

Technically, this is contrary to the rules..... a stand on vessel must stand on. However, with so many boaters seemingly unaware of all but the most basic rules, it may prove to be the best course of action.

Being one that will do what I have to avoid the potential for a problem on the water, I tend to give a very wide passage that would not put either boat in harms way if the non responsive stand on boat makes a significant change in direction or I just stay back.
