    John,
    The FAA and FCC will not prosecute you unless you use an aviation radio in
    an illegal manner. In a case of legitimate distress you will not be
    prosecuted for use of any radio on any band. As far as "yachtie kids having
    fun with a pilot", I'd be more concerned with the same kids placing
    fraudulent mayday calls on ch 16. Additionally there is no law against
    carrying an aviation radio onboard. They are readily available for retail
    purchase in aviation specialty shop and mail order outfits like Sporty's
    Pilot shop and Gulf Coast Avionics.
    I stand by my recommendation of carrying an aviation radio. The distress
    freq of 121.5 is only used for distress. It's not a hailing frequency like
    16 is on marine VHF.
