    Your last point was right at the nub. If you get hit it doesn't matter if
    you both did everthing you could it was not enough.
    If you do not get hit you may or may not be taking too much risk.
    The last is where I belive the real issue is.

    BTW, even if a radar is working perfectly the chance that it will always see
    another small boat in rough conditions is nil. Nor will you be able to see
    them in time if it is dark and very stormy.
    So now whose fault is it if you get hit?
    Given that there is always risk, the problem is to reduce that risk to
    acceptable levels for a given set of cirumstances. -Ken
