If you sail from or to, Spain, you have to cross spanish watters, if you are spanish (from Spain), i'm not a lawyer but i suppose you will be fined. If you don't have the proper title, i doubt that according the so many people (mainly from abroad) we have now in jail you will finally never enter in prision. If you are from other country i don't know what can be done, probably nothing (52 millions tourist have enjoy this year Spain) except the case you make something so bad you hurt or broke something or somebody so heavily without the proper insurance. And if so, maybe your country laws can also be considered, but this is a lawyer information. I'm not so prepared.
If you do that in other countries, then their laws to apply, (with the spanish governement to help if you are supported by titles or rights).
