    Mike,

    1. Passing in the ICW rarely causes damage, but it can be uncomfortable for
    the boat being passed. Most powerboaters offer the other boat the
    opportunity to slow down and experience little, if any, wake. You choose
    not to, so be it. But understand, if presented with the opportunity to slow
    down and you donšt, forget about a cause of action against the passing boat
    because you did nothing to mitigate your damages.

    2. I always slow down for small boats...and I have a pitiful wake.
