Nope. The underlying legal principle is a question of means of propulsion.
I imagine that if one were to dig deep enough into Admiralty Law--an
ancient, difficult, and arcane study if there ever was one--what they'd
discover is that the rather nebulous "machinery in operation" or how ever it
is worded was intended to be as inclusive a term as possible for every other
kind of propulsion--steam, diesel, electric, oil, what ever it was that Capt
Nemo was using, everything but sail and oar. If the other interpretation
were true, then having a genset running below would constitute being under
power and not sail.

And their kin. My experience was years ago with a military flying club at
Ft Devens, MA, where we had a surplus DeHavalland Otter (not to mention some
really neat tandem Cessnas taildraggers left over from Korea, O-2s or
something, with 235 hp on a tiny air frame with 60 degrees of flaps.). Also
a great old twin AeroCommander 500.
